Republicans are escalating the war on fentanyl with a blunt new message to drug dealers: Deal death, face death.
Rep. Chip Roy (R-TX) is unveiling legislation Tuesday that would allow prosecutors to pursue the death penalty against fentanyl traffickers whose drugs result in a user’s death.
The proposal, titled the “Deal Death, Face Death Act,” would amend the Controlled Substances Act of 1970 to permit capital punishment in fatal fentanyl distribution cases — a dramatic escalation in the federal government’s crackdown on the deadly narcotic flooding American communities.

“If a dealer distributes fentanyl or fentanyl-laced drugs and someone dies as a result, that dealer has effectively signed that person’s death warrant,” Roy said in a statement first obtained by Fox News Digital.
“Congress must stand with the families devastated by this crisis and send a clear message: if you deal death, you will face the full weight of justice,” he added.
Current federal law caps punishment for drug distribution offenses at life in prison.
Roy’s legislation would change that standard by adding language stating that if death results from use of the substance, the offender “shall be sentenced…to death.”
The bill would also sharply increase financial penalties tied to fentanyl trafficking, doubling current fines to as much as $2 million for individuals and $10 million for organizations or entities involved in distribution.
The proposal specifically targets fentanyl and fentanyl-related substances, including cases where heroin, cocaine or methamphetamine are knowingly laced with fentanyl.
Roy argued current law leaves a loophole that allows dealers to escape the harshest punishments even when unsuspecting buyers consume fentanyl-tainted drugs and die.
“[The act] closes a dangerous loophole and gives prosecutors the ability to pursue capital punishment against the worst offenders who are profiting off the deaths of Americans,” Roy said.
The push comes even as fentanyl deaths have started to decline nationwide.
According to the National Center for Health Statistics, nearly 48,400 Americans died from fentanyl poisoning in 2024 — a roughly 36% decrease from 2023 levels.
Still, fentanyl remains one of the deadliest narcotics in the country, with hundreds of Americans continuing to die every day from overdoses linked to the synthetic opioid.
