Interim FDA Commissioner Kyle Diamantas Was a Planned Parenthood Attorney

The man who will at least temporarily replace Marty Makary as the FDA Commissioner may be worse.

While pro-life groups called for Makary’s firing because he refused to put limits in place on the dangerous abortion pill mifepristone, his new replacement may be even less inclined to limit abortion drugs.

Acting FDA Commissioner Kyle Diamantas, who is temporarily leading the agency after Marty Makary’s resignation today, was an attorney for the nation’s largest abortion business.

Diamantas previously represented Planned Parenthood of Greater Orlando as an attorney in a 2017 Florida Supreme Court case, court records show.

Live Action President Lila Rose highlighted Diamantas’ past role Tuesday, expressing alarm that someone with ties to the abortion industry could oversee rules on the deadly chemical abortion pill.

“Acting FDA Commissioner Kyle Diamantas previously was listed in court records as counsel for Planned Parenthood of Greater Orlando,” Rose said. “We cannot allow someone who represented Planned Parenthood to oversee rules surrounding the deadly abortion pill mifepristone that has killed MILLIONS of babies.”

Rose called on President Donald Trump to appoint a strong pro-life nominee immediately to replace him in the position.

Florida Supreme Court documents from the case Planned Parenthood of Greater Orlando, Inc. v. MMB Properties identify Kyle A. Diamantas of Baker, Donelson, Bearman, Caldwell & Berkowitz, PC, in Orlando, as counsel for the abortion business.

Makary stepped down after 13 months leading the agency. The decision was made by Health and Human Services Secretary Robert F. Kennedy Jr. with White House approval, a senior administration official said.

“It was really Secretary Kennedy himself who made this decision,” the official said.

Makary drew sharp backlash from pro-life Republicans and pro-life groups who wanted the FDA to tighten restrictions on the abortion pill.

Susan B. Anthony Pro-Life America had called for his immediate removal.

“FDA Commissioner Makary should be fired immediately. Indifference is completely unacceptable to millions of pro-life voters expecting the administration to act to save lives,” Susan B. Anthony Pro-Life America President Marjorie Dannenfelser said.

Dannenfelser warned that Makary was “severely undermining President Trump and Vice President Vance’s pro-life credentials.”

Pro-life advocates have highlighted the continuation of Biden-era mail-order abortion pill policies, which they say enable chemical abortions even in states with strong protections for the unborn and have contributed to serious complications for women.

The resignation comes as two dozen states ask the Supreme Court to stop mail-order abortions.
