Amendment 6 in Nevada Would Allow Abortions Up to Birth

Nevada voters will decide in November whether to approve Question 6, a proposed constitutional amendment that would create an unlimited right to kill babies in abortion throughout all nine months of pregnancy,

That includes on healthy mothers with healthy babies.

The measure would establish that “All individuals shall have a fundamental right to abortion.”

Leading pro-life groups describe the proposal as dangerous, risky and extreme. They argue it would legalize abortions in the seventh, eighth and ninth months and go beyond what was permitted under Roe v. Wade or what most Nevadans support.

Under current Nevada law, abortion is allowed for any reason up to about 24 weeks, or six months.

After that point, abortion is permitted only in a licensed hospital to protect the life or health of the mother. Question 6 would eliminate that viability standard as currently applied and redefine fetal viability according to the professional judgment of the patient’s treating health care practitioner as the point when there is a significant likelihood of the fetus’s sustained survival outside the uterus without extraordinary medical measures.

The amendment would also replace the requirement that licensed physicians perform abortions with broader “qualified health care practitioners,” a category that under state law can include nurses, school nurses, dentists, opticians, pharmacy technicians and others – putting women’s lives and health at risk.

It would remove the state’s ability to regulate or inspect abortion facilities for health, safety and sanitation standards and the measure would permanently remove parental involvement requirements before an abortion is done on a minor and the baby.

They say this latter provision endangers young girls by allowing secret abortions that could protect predators and sex traffickers by destroying evidence and returning victims to abuse. They further contend that Question 6 would leave abortion clinics less regulated than nail salons and veterinary clinics, increasing risks to women.

Question 6 first passed with majority support on the November 2024 ballot. Because Nevada requires citizen-initiated constitutional amendments to win approval in two successive general elections, voters must approve it again on November 3, 2026, for it to take effect.
