This week, the Fifth Circuit Court of Appeals issued a ruling on a case that could spell Planned Parenthood’s doom.
And its decision wasn’t in the abortion business’ favor.
This case began when investigative reporter David Daleiden exposed Planned Parenthood’s demonic baby body parts business in 2015. The story led Texas and Louisiana to bar the abortion organization from their state Medicaid programs.
Planned Parenthood then sued to continue receiving this state funding. Both sides won victories at different points in the lawsuit, resulting in periods of time when the organization was barred from receiving the funding and periods when it wasn’t. The states won the final victory in 2020.

In 2021, an anonymous whistleblower alleged that Planned Parenthood submitted claims and received millions of dollars in funding from the states’ Medicaid programs during the periods it was barred from receiving the money. It also failed to return this illegal funding. The whistleblower sued Planned Parenthood on behalf of the states for these funds and the fines it incurred from making false claims.
If Planned Parenthood loses this suit, it will owe approximately $1.8 BILLION.
Planned Parenthood claims that it can’t be held liable because it was only acting on its attorneys’ advice, but a federal judge disagreed and ruled against the organization in 2023. The abortion business then appealed the case to the Fifth Circuit Court of Appeals, which in February 2025 issued a ruling favorable to Planned Parenthood.
In June 2025, however, the court vacated its ruling and granted a rehearing.
On August 12, 2026, the Fifth Circuit Court of Appeals issued its new ruling on the case, finding that the court lacks jurisdiction and cannot rule on it. It returned the case to the federal court that made the initial ruling against Planned Parenthood.
While this case has the potential to cripple Planned Parenthood financially, it isn’t over yet. And we are all too aware of the legal system’s tendency to ignore the blood of the millions of slain preborn babies, who cry out for justice.
