Bondi says the fight is far from over.
U.S. Attorney General Pam Bondi vowed Monday that the Justice Department will continue its effort against former FBI Director James Comey and New York AG Letitia James—despite a federal judge dismissing the charges.
“We’ll be taking all available legal action, including an immediate appeal, to hold Letitia James and James Comey accountable for their unlawful conduct,” Bondi said, according to Fox News.
“I’m not worried about someone who has been charged with a very serious crime,” she added, referring to Comey. “His alleged actions were a betrayal of public trust.”
The ruling came from U.S. District Judge Cameron McGowan Currie, who dismissed the charges without prejudice on procedural grounds. The Daily Wire reported that the judge found Lindsey Halligan—the Trump-appointed prosecutor behind the indictments—was unlawfully serving as interim U.S. attorney.
President Donald Trump had appointed Halligan to replace former U.S. attorney Erik Siebert, who led investigations into Comey and James but did not indict them. Halligan previously served on Trump’s legal team.
Bondi said Halligan will remain involved in the case: “We have made Lindsey Halligan a special U.S. attorney so she is in court, she can fight in court just like she was, and we believe we will be successful on appeal.”
She also defended Halligan’s credentials: “And I’ll tell you, Lindsey Halligan, I talked to all of our U.S. attorneys, the majority of them around the country, and Lindsey Halligan is an excellent U.S. attorney,” Bondi said. “And shame on them for not wanting her in office.”
The DOJ indicted James Comey in September for false statements and obstruction of a congressional proceeding, tied to his 2020 testimony on the FBI’s handling of the 2016 Russia investigation.
Letitia James was charged in October over a 2023 mortgage loan on a Virginia home she claimed as her primary residence—despite serving as New York attorney general, a position that requires residency in New York. The home was reportedly occupied by a relative and came with more favorable loan terms.
