Virginia Abortion Amendment is So Radical It Allows Abortions Up to Birth

Next year, the Virginia legislature will promote a state amendment so radical that it should shock most people.

There is a constitutional amendment that is an extreme, radical, and deadly measure that would enshrine virtually unlimited abortions at any stage of pregnancy, including up to birth, stripping away longstanding protections for the unborn.

The amendment, dubbed the “Unlimited Abortion up to Birth Amendment” by opponents and formally known as the Reproductive Freedom Act, cleared both chambers of the Democrat-controlled General Assembly in the 2025 legislative session.

It establishes a “fundamental right to reproductive freedom,” that essentially allows abortions up to birth with only flimsy limits on late-term abortions.

If the Democrat-run legislature approves the amendment again, which is likely, it will go before voters.

Victoria Cobb of the Family Foundation says the extreme nature of the amendment is shocking and her group is working to alert Christian and conservative voters.

“n 2025, our Church Ambassador Network led by Pastors Mike Morisi, Shane Bost and Bryan Keith, along with our strategy team fighting the abortion amendment, reached 880 pastors educating and alerting them to the Left’s evil agenda,’ she said.

Cobb described how evil the amendment is by outlining what it would do:

  1. Make abortion legal for any reason up to the moment of birth
  2. Remove parental notification for abortions for minors
  3. Remove safety restrictions (effectively making literal back alley abortions legal)
  4. Make abortion easier on all counts
    1. More accessible
    2. Less stigmatized
    3. Built-in points of no return removed

“Many Christians still do not know the atrocity that is the coming abortion amendment,” she said. “The Church Ambassador Network is working relentlessly to change that. Our team has met individually with 514 pastors and directly shared God’s truth about life to over 18,000 people all over Virginia!”

“We’ve poured countless hours into crisscrossing Virginia, speaking in more than 65 churches and the battle is only intensifying. We must accelerate this momentum next year,” Cobb added.

Cobb says her group won’t back down in fighting the amendment despite the uphill battle.

“Though the election results make the battle harder, we will continue to work fearlessly to stand for life,” she said.

Critics argue this language effectively nullifies any meaningful restrictions, removes age limits and safety standards, and threatens parental consent laws as well as conscience protections for health care workers who object to performing abortions.

“This amendment would allow virtually unlimited abortion at any stage of pregnancy,” Arlington Bishop Michael Burbidge and Richmond Bishop Barry Knestout wrote in a joint letter to Catholics across the state.

The measure’s passage marks the first of two required approvals by the legislature. It must clear both the House of Delegates and the Senate again in the 2026 session before appearing on the November 2026 ballot, where a simple majority of voters could ratify it.
