Federal Appeals Court Temporarily Restores Trump’s 10% Global Tariff After Lower Court Ruling

President Donald Trump scored a temporary legal victory Tuesday after a federal appeals court stepped in to keep his administration’s sweeping 10% global tariff alive — at least for now.

The U.S. Court of Appeals for the Federal Circuit issued an administrative stay pausing a lower court ruling that had sided with three importers challenging the tariff under Section 122 of the Trade Act.

That means the tariffs immediately snap back into effect for the plaintiffs while the appeals court decides whether to grant a longer-term pause.

The legal fight centers on Trump’s February decision to impose a broad 10% tariff on global imports after the U.S. Supreme Court struck down most of the administration’s earlier 2025 tariff plan.

Last week, the U.S. Court of International Trade ruled against the administration’s new tariff structure. But the decision was narrow and only applied to the specific challengers in the case rather than shutting down tariff collections nationwide.

Those challengers included two businesses and Washington state, which qualified as an importer because the University of Washington paid tariffs on imported goods tied to its research operations.

Now, the appeals court has temporarily reversed that outcome.

The challengers have seven days to argue against a longer stay while the litigation continues.

The 10% tariff is currently scheduled to expire in July unless Congress votes to extend it — setting up another political and economic showdown on Capitol Hill this summer.
