Indiana is Fighting to Keep Planned Parenthood Defunded

Planned Parenthood may see federal funding resume, but one pro-life state is fighting to ensure the nation’s biggest abortion company doesn’t get taxpayer dollars.

Indiana officials are fighting to keep Planned Parenthood defunded from the state’s Medicaid program by seeking to enforce a 2011 state law that bars taxpayer dollars from going to organizations that kills babies in abortions.

Despite the expiration of a federal ban on such payments on July 4, Indiana Attorney General Todd Rokita’s office is asking a federal appeals court to lift a 2013 injunction that had allowed the funding to continue for non-abortion services.

The 2011 law prohibits state agencies from contracting with or granting funds to organizations that kill babies in abortions or have facilities where abortions are done, with exemptions for hospitals and ambulatory surgical centers.

In 2013, U.S. District Judge Tanya Walton Pratt issued a permanent injunction blocking enforcement of the state law. The U.S. Supreme Court overturned the key reasoning behind that injunction in 2025.

Rokita’s office is now moving to dismiss the order entirely.

Planned Parenthood has agreed to “remain suspended from Indiana’s Medicaid program” while the case is pending before the 7th U.S. Circuit Court of Appeals in Chicago. In recent court filings, the attorney general’s office argued there is no reason to “keep the injunction on life support” and stated the state “has no intention of attempting to recoup past Medicaid payments” made to the organization.

State records show Indiana paid Planned Parenthood $1.7 million in 2024 and $1.6 million in 2025 for Medicaid services. Planned Parenthood halted abortions at its clinics in Indiana in 2022 thanks to the state’s abortion ban protecting babies.

Jennifer Allen, CEO of Planned Parenthood Alliance Advocates, denounced the state’s actions.

But pro-life advocates support Indiana’s efforts to protect taxpayers from funding the nation’s largest abortion company and are urging stronger action nationwide following the expiration of the federal ban.
